This book contains a collection of the contributions for the “On the Brink of European Patent Law” conference, which was held in Utrecht on 11 January 2010 at the occasion of Prof. Jan Brinkhof’s retirement as a professor of IP law at the University of Utrecht. Also included is his farewell address “The European Challenge”, which was given on 27 January 2010.

Leading patent judges, academics, and practicing lawyers from Germany, England, and the Netherlands and members of the Boards of Appeal of the European Patent Office discuss topics such as scope of protection, partial revocation, inventive step, prosecution history, and contributory infringement. Those issues are to a large extent harmonized and unified law. However, in the absence of a highest European court, it is up to national courts to develop a uniform application and interpretation of European patent law and to provide the legal certainty and predictability which litigants need. The contributions in this book should provide inspiration in that regard.
