Description

This book provides a roadmap of the law applicable to the food sector in the EU. Rules and regulations are to be found at the international level, the European level and the private sector level. National legislation of the individual Member States is not covered in this book. International food law largely is a meta-framework providing models and setting limits to the way states and other entities, such as the EU, regulate the food sector. The Codex Alimentarius plays a central role at the international level. European law comprises a mix of rules. In the food sector the core of European food law can be found in a Regulation best known as the ‘General Food Law’ Regulation. An increasing number of EU Regulations applicable in this field directly address consumers and businesses in the same way national legislation does. In addition, there are EU directives requiring Member States to include harmonized provisions in their national legal system. Finally, the private sector has formulated schemes consisting of private standards that are embedded in certification procedures. These schemes are based on EU legislation taking it beyond the borders of the EU, elaborating it in more detail or simply ensuring compliance. Some schemes are based on international models.

The roadmap provides an overview of the structure and content of food law in such a way that it is clear which rules are applicable.  As the food sector has become one of the most heavily regulated sectors in the EU, a book that specifically deals with the law in this field cannot fail to be of importance to anyone interested in food law.

Author's information

Irene Scholten-Verheijen
Irene Scholten-Verheijen works as an attorney at law and is partner at the law firm VMW Taxand in Amsterdam. Her focus is on regulated markets, in particular food and pharma. In her current practice she counsels and litigates on regulatory issues, compliance, liability and claims. She represents corporate entities in proceedings against government administrations.Irene is a member of the Dutch Food Law Association (NVLR) and the European Food Law Association (EFLA) and is a board member of the European Institute for Food Law.
She gives lectures on a regular basis and has several publications to her name.

Theo Appelhof
Theo Appelhof is a chemist (University of Utrecht, the Netherlands). In the period 1975 to 2005 he was employed as a chemist and director at the Dutch Food Safety Authority (Keuringsdienst van Waren or “nVWA”) in Nijmegen, Leeuwarden and Eindhoven. Together with Precon Food Management BV he worked on various EU projects in Estonia and Lithuania. In these and other projects, local legislation was amended in preparation for accession to the EU.   

Since his retirement in 2005 Theo Appelhof has served Précon Food Management BV in Bunnik as a consultant. He is currently a member of the editorial board of the Dutch “practical guides on the Commodities Act” (Praktijkgidsen Warenwet), and writes for these publications on subjects related to foodstuffs such as claims and labelling. 

Ronald van den Heuvel
Ronald van den Heuvel graduated in food science and technology at Wageningen University, the Netherlands. While based in the United Kingdom he worked in many European countries as a business developer and market analyst. In 2009 he started working as a consultant for Préscon Food Management BV, providing legal and food safety management advice to food producing companies. He was a lecturer at the Food Law Academy on the topic of labelling.
He is currently self-employed and analyses food safety issues and international markets. He is also linked to the European Chair of Food Safety Microbiology at Wageningen University through the development of digital learning materials.
